Notice of Proposed Rules
Summaries of all proposed new rules, proposed amendments, and proposed repeals approved for publication in the Texas Register to receive public comment are available here. Rule actions will remain on this page until filed as adopted with the Texas Register.
A weekly publication, the Texas Register serves as the journal of state agency rulemaking for Texas. Information published in the Texas Register includes proposed, adopted, withdrawn, and emergency rule actions, notices of state agency review of agency rules, governor's appointments, attorney general opinions, and miscellaneous documents such as requests for proposals. After adoption, these rulemaking actions are codified into the Texas Administrative Code. The Texas Register is available here.

Proposed Amendments
The Texas Board of Criminal Justice (TBCJ or board) proposes the following amendments, which have been reviewed by legal counsel and found to be within the board’s authority to adopt.
Proposed Amendments for the February 21, 2025, TBCJ Meeting:
to 37 Texas Administrative Code §152.71, concerning Acceptance of Gifts Related to Buildings for Religious and Secular Programs. The proposed amendments revise “offender” to “inmate” and “rule” to “section” throughout; revise the policy statement for clarity; remove language specifying a building related to the provision of religious and secular programs; add language to state the TDCJ shall meet with donor groups to evaluate a prospective donated building or enhancement; revise language to state a donor or designee will be qualified; remove language requiring the building to be used for religious and secular programs; and add language to specify building enhancements.
Enmiendas al Título 37 del Código Administrativo de Texas §152.71, concerniente a la Aceptación de Obsequios Relacionados con Edificios para Programas Religiosos y Seculares. Las enmiendas propuestas modifican “ofensor” por “recluso” y “regla” por “sección” en todo el texto; revisar la declaración de política para mayor claridad; eliminar el lenguaje que especifica un edificio relacionado con la provisión de programas religiosos y seculares; agregar un texto que indique que el TDCJ se reunirá con grupos de donantes para evaluar un posible edificio o mejora donado; revisar el lenguaje para indicar que un donante o persona designada estará calificado; eliminar el lenguaje que requiere que el edificio se use para programas religiosos y seculares; y agregue lenguaje para especificar las mejoras del edificio.
Amendments to 37 Texas Administrative Code §163.33, concerning Community Supervision Staff. The proposed amendments revise “rule” to “section” throughout; revise the definition of “direct supervision”; and make grammatical and formatting updates.
Enmiendas al Título 37 del Código Administrativo de Texas §163.33, concerniente a la Personal de Supervisión Comunitaria. Las enmiendas propuestas revisan “regla” a “sección” en todo su texto; revisar la definición de “supervisión directa”; y realizar actualizaciones gramaticales y de formato.
Amendments to 37 Texas Administrative Code §163.42, concerning Substantial Noncompliance. The proposed amendments reflect the Office of the Independent Auditor as independent of the TDCJ.
Enmiendas al Título 37 del Código Administrativo de Texas §163.42, en relación con el Incumplimiento Sustancial. Las enmiendas propuestas reflejan que la Oficina del Auditor Independiente es independiente del TDCJ.

Proposed Rule Reviews
The Texas Board of Criminal Justice (TBCJ or board) proposes the following rules for rule review. An assessment will be made by the board as to whether the reasons for readopting these rules continue to exist. The rules will be reviewed to determine whether to readopt, readopt with amendments, or repeal the rule.
